Legal Bases

1. ORGANIZING COMPANY OF THE PROMOTION

The company FOODBOX, S.A., with registered office at C/ Nuñez Morgado, 6 – 28036 Madrid and identified with CIF/NIF number A-87240420, is organizing the giveaway (hereinafter, "the Promotion") on a national level, to be conducted via the Internet, exclusively for users residing in Spain in accordance with the participation requirements outlined below.

The purpose of this giveaway is to reward user collaboration and content creation.

2. START AND END DATES

The Promotion will begin on June 16, 2025, at 12:00 p.m., and will end on July 7, 2025, at 12:00 p.m.

The Company reserves the right not to carry out the promotional action if, by the indicated start date, fewer than 5 participants have registered. Likewise, the Company may extend the promotion by an additional 2 weeks, with a new end date of July 14, 2025, if more than 10 participants have registered.

3. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

Participation requirements are as follows:

  • Participants must be over 18 years of age.

  • Only individuals with an Instagram account may participate.

  • Participants must comment on the brand’s Instagram post tagging at least one friend during the participation period.

  • Each participant may only participate with one Instagram profile. If it is detected that a participant is using multiple profiles, they will be disqualified.

  • The application will accumulate mentions and hashtags from the same participant, even if posted in different comments.

  • Users must share at least one story tagging the brand.

4. PROMOTION CONDITIONS AND PRIZES

The winner will be chosen randomly via the Wask platform. The winner will be announced on July 7 through the brand’s social media profiles, along with a certificate of validity for the draw.

The prize will be a lunch or dinner valued at €50 at the Papizza Fuencarral location (Fuencarral, 80).

The prize may be redeemed between July 7 and September 30.

The prize cannot be exchanged for cash or any other reward and may not be altered or transferred.

If the total bill exceeds €50, the remaining amount must be paid by the customer.

If the full €50 is not used, the remaining amount will not be refunded.

The prize is indivisible and must be used in a single visit.

The Company reserves the right to modify the prize if, by the time the winner is declared, there are issues or impossibilities preventing the prize from being awarded.

The winner has 15 days from the announcement on the brand’s social media to contact the company. If no contact is made within this period, the draw may be declared void or a second winner may be announced.

The giveaway and prize granting are subject to current tax regulations.

5. DISQUALIFICATIONS AND PENALTIES

If it is found that any participant does not meet the requirements of the Terms or provides invalid information, their entry will be considered void and they will be automatically disqualified, forfeiting any prize awarded.

The Company reserves the right to declare the giveaway void.

6. PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions that are deemed inappropriate, offensive, abusive, discriminatory, or that may infringe on the rights of third parties will not be permitted. Comments against individuals that violate the rights to honor, personal and family privacy, and self-image will also be prohibited. The Company will not be held responsible for any damages caused by comments made by Participants that may hurt others’ sensibilities.

Participation in this Promotion and the comments made by Participants must not, under any circumstances, violate Instagram’s Community Guidelines or Terms of Use.

If fraudulent means of participation are detected (such as the use of bots in the comments), the prize will not be awarded and will remain the property of the Company.

7. DISCLAIMER OF LIABILITY

By way of example and not limitation, we are not responsible for potential losses, theft, delays, or any other circumstances attributable to third parties that may affect the development of the Promotion. We are also not responsible for the Participant’s use of the prize obtained through the Promotion.

We assume no liability in cases of force majeure or unforeseen circumstances that may prevent the Promotion or the full or partial enjoyment of the prize.

If the Promotion cannot be carried out due to fraud, technical errors, or any other reason beyond the Company’s control that affects the normal development of the Promotion, we reserve the right to cancel, modify, or suspend it, including the participation website.

8. PERSONAL DATA PROTECTION

The company responsible for processing your data is FOODBOX, S.A., with address at C/ Nuñez Morgado, 6 – 28036 Madrid and CIF/NIF: A-87240420.

In accordance with the General Data Protection Regulation (GDPR), by accepting these Terms and Conditions, each participant consents to their personal data being added to a file owned by the Company, for the purpose of managing the giveaway, as well as publicizing its results and processing prize delivery.

You are informed that you may exercise your rights of Access, Rectification, Erasure, Objection, Restriction of Processing, Data Portability, Right to be Forgotten, and not to be subject to automated decision-making by sending an email to social@agenciarodrigo.com or by mail to the following address: C/ Nuñez Morgado, 6 – 28036 Madrid, in both cases including a copy of an identification document.

Without prejudice to any other administrative or legal remedy, participants have the right to file a complaint with a Supervisory Authority, particularly in the Member State of their habitual residence, workplace, or place of the alleged infringement, if they believe that the processing of their personal data is not compliant with applicable regulations or if their rights have not been upheld.

By participating, the Participant acknowledges being informed of and consenting to the data protection conditions.

9. CHANGES AND ACCEPTANCE

We reserve the right to modify or extend these promotional terms and conditions, provided such changes do not prejudice or undermine the rights of the Participants.

Simply participating in the giveaway implies full acceptance of these Terms and Conditions. Participation in a giveaway of this nature also implies acceptance of Instagram’s platform rules.

10. APPLICABLE LAW AND JURISDICTION

These legal terms are governed by Spanish law. Any claims or disputes arising with respect to the validity, interpretation, or enforcement of these terms shall be resolved by the courts and tribunals of the Participant's place of residence.
